1. COMMITMENT TO INTELLECTUAL PROPERTY PROTECTION

1.1 Our Respect for Copyright

Resomix is committed to respecting and protecting the intellectual property rights of music creators, rights holders, labels, publishers, and all stakeholders in the music industry. We recognise that robust copyright protection is essential for a healthy creative ecosystem.

1.2 Zero Tolerance for Infringement

We maintain a zero-tolerance policy toward copyright infringement and will take swift action to address any infringing activity.

2. SERVICE CLASSIFICATION AND ARCHITECTURE

2.1 Discovery Engine — Not Hosting Service

Resomix operates as a music discovery engine that analyses sonic characteristics. Resomix is not a public music-hosting or distribution service and does not operate a public user-upload catalogue. This distinction is fundamental to our service design.

2.2 Service Architecture

The Service handles audio in three distinct ways:

**(a) Temporary Reference Uploads: **Audio uploaded for one-off similarity or Track Intelligence analysis is processed for the individual user’s private analysis, is retained only for processing and deleted no later than 24 hours after upload or analysis, and is never made publicly available, indexed for other users, or shared. There is no feature through which one user can access another user’s uploaded audio, and Resomix does not organise, curate or promote user-uploaded content.

**(b) Private Resomix Libraries and Partner Catalogue Content: **Audio supplied to a customer-authorised Private Resomix Library or under a written partner catalogue arrangement may be retained for the duration necessary to provide the authorised catalogue-analysis and discovery service. Such content is logically isolated, restricted to authorised access and deleted in accordance with the applicable account, removal request, agreement, termination or deletion schedule.

**(c) Catalogue presentation in the current beta experience: **Resomix searches its own pre-analysed sonic index. Apple MusicKit supports catalogue metadata, previews and authorised playback presentation; playback of Apple Music-linked tracks is delivered through Apple Music under Apple’s applicable terms. Apple MusicKit does not perform PYXIS-1 analysis, generate Resomix sonic profiles or calculate Resomix similarity rankings.

2.3 Upload Processing and Retention

When a user uploads audio as a Temporary Reference Upload, the PYXIS-1 engine analyses more than 70 measurable audio characteristics and may segment the audio into structural sections (e.g., intro, drop, outro) to deliver the requested analysis. Audio submitted as a Temporary Reference Upload is retained only for processing and deleted no later than 24 hours after upload or analysis. Temporary previews and processing artefacts are retained only for as long as reasonably necessary to provide, troubleshoot and secure the requested processing. The derived sonic profile is created for analysis and similarity retrieval and is not intended to function as a playable substitute for the source recording. Private Resomix Library and partner catalogue content follows the retained-content rules described in Section 2.2(b).

3. LEGAL FRAMEWORK

3.1 DMCA Compliance

We respond to notices of claimed copyright infringement in accordance with the procedures in this Policy, including notices submitted under the United States Digital Millennium Copyright Act (17 U.S.C. § 512). We maintain a designated copyright contact, operate a notice-and-takedown process for content within our control, and apply a repeat-infringer policy.

3.2 EU Copyright Framework

Our approach under Directive (EU) 2019/790 and related EU copyright law is as follows: (a) playback of commercial recordings in the current beta experience is delivered through Apple Music under Apple’s applicable terms, with Apple MusicKit supplying catalogue metadata and previews, and Resomix operates its own pre-analysed sonic index as described in Section 2.2; during our earlier demo phase the platform operated with CC BY 4.0-licensed content; (b) we do not host, organise or give public access to user-uploaded copyrighted works (Section 2.2(a)); (c) we are committed to introducing appropriate content-recognition measures before enabling any functionality that could involve public hosting of user-provided copyrighted material; (d) direct ingestion and activation of partner catalogues takes place only under written agreements with rights holders; and (e) we will act on specific works identified by rights holders in accordance with the procedures in this Policy.

3.3 Repeat-Upload Measures

For repeat infringers and clearly identified copyrighted works, we may implement proactive measures to prevent re-uploading of previously removed content, consistent with EU jurisprudence (Case C-401/19 Poland v Parliament and Council).

4. CONTENT SOURCES AND DEVELOPMENT PROVENANCE

4.1 Catalogue Content

Playback of Apple Music-linked tracks in the current beta experience is delivered through Apple Music under Apple’s applicable terms; Apple MusicKit supplies catalogue metadata, artwork and previews. Resomix searches its own pre-analysed sonic index, which may include customer-authorised Private Library tracks, partner-authorised catalogue tracks and a growing collection of Apple Music-linked tracks already analysed by Resomix. During our earlier demo phase, Resomix operated with content licensed under CC BY 4.0 from repositories including Openverse, Jamendo, Free Music Archive, and the Internet Archive. Apple Music is a trademark of Apple Inc. Resomix is not affiliated with, endorsed by or partnered with Apple.

4.2 Development and Testing

The PYXIS-1 engine was developed and tuned over approximately one year using openly licensed CC BY 4.0 test material.

PYXIS-1 is a proprietary Python-based algorithmic system that performs specific pre-processing of audio files and analyses more than 70 measurable audio characteristics using established audio-analysis utilities — including Librosa, Essentia, Madmom, FFmpeg and other documented audio-analysis utilities — combined with private Resomix code to create sonic profiles for each audio file and calculate similarity relationships between them.

PYXIS-1 is not a trained machine-learning model or neural-network system: it does not train or fine-tune itself using user or partner audio, does not adapt from user interactions, and does not generate, synthesise or recreate audio.

4.3 Development Documentation

We maintain comprehensive documentation of our development and testing methodology, including: (a) content sources used during development and testing (exclusively CC BY 4.0 licensed repositories); (b) audio-analysis utility versions and configurations (Librosa, Essentia, Madmom, FFmpeg); (c) feature extraction specifications (70+ audio features including rhythm, harmony, timbre, energy, and production characteristics); (d) similarity calculation methodologies and algorithmic logic at a general level; and (e) validation and testing procedures used to evaluate recommendation quality.

This documentation may be made available to rights holders upon reasonable request and subject to execution of an appropriate non-disclosure agreement. Resomix will provide transparency regarding its general technical approach, feature extraction categories, content sourcing practices, and validation methodology. Proprietary implementation details, source code, algorithmic weighting, and similarity scoring formulas constitute Resomix’s trade secrets and will not be disclosed. We are committed to transparency with licensing partners regarding our technical approach while protecting our intellectual property.

5. DMCA DESIGNATED AGENT

Our designated agent for receipt of notifications of claimed infringement is: Resomix Copyright Agent, Resomix, Email: [email protected], Location: Greece.

Playback of Apple Music-linked tracks is delivered through Apple Music; Temporary Reference Uploads are never made publicly accessible; and retained Private Library and partner catalogue content is restricted to authorised access (Section 2). We accept and process all good-faith copyright notifications received at the address above. Notices concerning United States law are handled under the procedures in Sections 6 to 8.

6. TAKEDOWN NOTICE REQUIREMENTS

A valid DMCA takedown notice must include:

A physical or electronic signature of the copyright owner or authorised agent;

Identification of the copyrighted work claimed to be infringed;

Identification of the allegedly infringing material with sufficient location information;

Your contact information (name, address, telephone, email);

A statement of good faith belief that the use is not authorised;

A statement, under penalty of perjury, that the information is accurate and you are authorised to act.

6.1 Processing Timeline

We use reasonable efforts to process valid takedown notices promptly — in typical cases within two (2) business days of receipt.

6.2 Notice Route from the Upload Flow

A link to this Policy and to the notice route ([email protected]) is provided directly from the audio upload screen, alongside the rights-warranty confirmation that users must give before uploading: “By uploading, you confirm you own or control the rights to this audio, or are authorised to submit it for analysis.” Rights holders and users can reach the notification procedure in one step from the point of upload.

7. COUNTER-NOTIFICATION PROCEDURE

If you believe material was removed by mistake, you may submit a counter-notification including your signature, identification of the removed material, a statement under penalty of perjury that removal was the result of mistake or misidentification, your contact information, and consent to jurisdiction.

8. REPEAT INFRINGER POLICY

A repeat infringer is any user who is the subject of two (2) or more valid takedown notices within any twelve (12) month period. Repeat infringers will have their accounts permanently terminated in accordance with 17 U.S.C. § 512(i). We reserve the right to terminate any account after a single valid takedown notice where the circumstances indicate wilful or egregious infringement.

9. TRANSPARENCY REPORTING

Resomix is committed to transparency regarding intellectual property enforcement. As enforcement volume develops, we intend to publish periodic transparency summaries covering: (a) takedown requests received; (b) requests actioned; (c) counter-notifications received; and (d) accounts terminated under our repeat-infringer policy. Early periods may reflect minimal enforcement activity given the platform’s architecture.

10. RIGHTS-HOLDER COOPERATION AND PARTNERSHIP

10.1 Complementary Service Model

Resomix is designed as a complementary discovery layer that activates dormant catalogue without cannibalising existing distribution channels. We surface long-tail content that traditional discovery methods overlook, driving incremental engagement and revenue through authorised platforms. This capability is currently demonstrated against the current beta catalogue experience described in Section 4.1, with commercial catalogue activation available upon execution of licensing agreements with rights holders.

10.2 Partnership Opportunities

We welcome discussions with rights holders about licensing partnerships. Upon execution of appropriate licensing agreements, the following partnership models will be available: (a) Catalogue Licensing with transparent revenue sharing and structured reporting (formal DDEX ERN ingestion and DDEX DSR reporting are not currently implemented; DDEX-aligned ingestion and reporting remain planned roadmap capabilities); (b) White-Label Integration of the PYXIS-1 engine for partner platforms; and (c) Strategic Co-Development opportunities.
